Road Traffic Accidents Claims

Introduction to Road Traffic Accidents

At AClaim our legal experts, and their families seek compensation for a variety of road traffic accidents and incidents that can lead to injuries ranging from minor to life-altering.

Your life can be drastically altered by a road traffic accident.

Besides physical trauma, being hurt suddenly and unexpectedly can cause psychological shock.

It takes time for road accident injuries to heal. In some cases, they could cause permanent damage, life-changing problems, or even be life-threatening.

There is nothing we can do to take away what you have been through, but we can assist you in making a no win no fee claim for a traffic accident.

It is our goal to help you obtain the recovery support and compensation you deserve after an accident caused by the negligence of another person.

Our success depends on our ability to understand the impact of events on you, your family, your work life, your home life, and your future.

Whether your injury is temporary or permanent, we’ll help you get things back on track.

If you have been involved in a road traffic accident, we can typically recover compensation for the following:

  • Injuries to you
  • The cost of medical care
  • General expenses
  • Earnings loss
  • Help with the MIB (Motor Insurers Bureau), which is needed when the other driver is uninsured
  • A replacement vehicle, any repairs needed, or the loss of and use of your own vehicle
  • Excess insurance

Types of Road Traffic Accidents

Car Accidents

In 2020, when fewer vehicles were on the road, 42% of road deaths involved car occupants. A car accident seriously injured nearly 4,000 adults between the ages of 25 and 59. Source: Department for transport

With around 80% of all road traffic in the UK being car traffic, it comes as no surprise that car occupants make up the highest number of road deaths.

Motorbike Accidents

Motorcycle registrations in the UK increased by 1.27 million in 2020, while fatal accidents decreased by 30%.

On average, there are 21,000 motorbike accidents each year, 80% of which are caused by negligence.

However, the negligence isn’t necessarily the fault of the riders or drivers. Defects, debris, potholes, and oil spills can contribute to highway accidents.

84% of road casualties involving a motorbike involved a car as well. Poor turning, manoeuvring and failure to anticipate the bike’s movement were the most common causes of accidents.

Bus Accidents

With nearly 4.5 billion bus journeys made across the country in 2021, the vast majority of bus trips are completely safe and incident-free. However, accidents do happen.

It is common for passenger accident claims to involve head and neck injuries. Although spinal cord and back injuries are rare, emotional trauma can result in a variety of symptoms.

It is not just passengers who are at risk, but pedestrians and other road users as well.

According to the Department for Transport, in 2021 there were 1,774 reported bus and coach casualties across the UK. Source: Department for transport

Bicycle and E-Bike Accidents

Over 6.5 million cyclists use UK roads each year, with only one cyclist killed every year, 33 seriously injured, and 103 slightly injured.

An injury claim can be filed if a person is injured on a bike due to things such as a bicycle component failure, a collision with another road user, or being thrown from their bicycle after hitting debris or potholes.

The main cause of bicycle accidents on the road is often the result of a collision with a motor vehicle.

According to data from the Department for Transport in the UK, the most common cause of bicycle accidents is failure of the driver to see the cyclist, particularly at junctions.

Other causes of bicycle accidents include poor road design, such as the lack of dedicated cycle lanes or the presence of obstacles such as potholes, and driver behaviour, such as speeding, driving under the influence of drugs or alcohol, and reckless or careless driving.

E-Bikes

With the rise of convenience and government schemes, e-bikes are becoming more popular.

The study by Shimano found that 38% of people who answered and participated said they used e-bikes as an alternative to public transportation.

There is, however, also the inevitability of more incidents with this increase in popularity.

For example, a study in the Netherlands found that accidents and injuries on eBikes have increased on bike-friendly Dutch roads. This resulted in eBike riders being 1.6 times more likely than ordinary cyclists to visit A&E than others.

Some of the most common reasons for e-bike accidents include:

  • Rider error, such as loss of control or failure to properly assess road and traffic conditions
  • Lack of proper training or experience with e-bikes
  • Rider impairment (e.g. alcohol or drug use)
  • Vehicle defects, such as malfunctioning brakes or poor tire maintenance
  • Poor road conditions
  • Collision with other vehicles or pedestrians

What is the time limit for claiming compensation for Road Traffic Accident (RTA) injuries?

In order to file a claim for a road traffic accident, generally you must do so within 3 years of the incident taking place.

This timescale may differ if the accident involves fatalities or if the person who has been injured has been mentally impaired.

Injured children must make a claim no more than 3 years after their 18th birthday.

In these cases it’s important to contact us as soon as possible if you have suffered a road traffic injury.

We can then start your claim to recover any compensation you are entitled to so you can start to rebuild your life.

I was out on my motorbike and got hit by a van on the wrong side of the road and the driver was drunk. Gary came to visit me at my home - 200 miles away! so he could find out what happened and help me claim compensation. Thanks to Gary I no longer have to worry about how I'm going to pay my mortgage or support my family financially while I'm getting treatment.
Highly recommend Gary

AClaim came highly recommended to me by someone at the bike club. I suffered a life-changing accident after I was hit by someone running a red light at nearly 50mph. The first accident I've had in 42 years of riding!! As a result I can no longer ride. The decision to hang up my biking gear was a difficult one, but AClaim's guidance and support have made navigating this challenging time a bit easier. Thank you to Gary and the team for everything you have done.
So glad I found AClaim
