Understanding Motorcycle Accident Compensation

Motorbike accidents can result in severe injuries, impacting your life physically, emotionally, and financially.

What is compensation?

Motorcycle accidents compensation refers to the financial reimbursement awarded to victims of motorcycle accidents to compensate for their losses and damages.

Types of compensation available for motorbike accidents

There are many different types of compensation available including, but not limited to:

  1. Medical expenses: Coverage for private medical bills, hospital stays, surgeries, medications, and rehabilitation.
  2. Lost wages and income: Compensation for income loss due to inability to work during recovery.
  3. Pain and suffering: Damages awarded for physical and emotional distress caused by the accident.
  4. Property damage: Reimbursement for repairs or replacement of the motorcycle and other damaged property.
  5. Rehabilitation and therapy costs: Compensation for ongoing therapy, counselling, or rehabilitation needs.

How much compensation will you be awarded following a motorbike accident?

When calculating the amount of compensation, each personal injury case will be assessed on an individual basis.

There are a number of factors that will impact all or some of the damages in a personal injury case. These can include:

  • How severe the injury is and the severity of the accident
  • Whether you require private medical care
  • Whether or not pain is present and how severe it is
  • The impact it has had on your everyday life
  • The extent to which you are dependent on others
  • The amount of time the symptoms or injuries are likely to last
  • If you are experiencing any other side effects, such as depression or anxiety
  • Whether you are able to continue working
  • Whether you will need rehabilitation or long term care

Compensation amounts range from mild to very serious for road traffic accidents.

Here are the 15th Edition guidelines for injuries commonly associated with motorcycle accidents.

  • Facial Injury £1,460 – £344,640
  • Head Injury £1,880 – £344,460
  • Severe neck injury £38,800 – £126,550
  • Moderate brain damage £36,740 – £186,890
  • Paraplegia £186,890 £242,490
  • Moderate shoulder injury £6,730 – £10,890
  • Severe back injury with spinal cord damage £77,700 – £137,330
  • Hip or pelvis injury £3,370 – £111,690
  • Fractured forearms £5,630 – £16,380
  • Fractured thigh bone (femur) £7,780 – £12,010

The importance of compensation: Why it’s crucial for victims of accidents

Compensation is not just an option but a necessity for those who have suffered an accident.

If you have been injured, you may be entitled to compensation for things such as pain and suffering, loss of earnings, private medical and rehabilitation costs.

If you have lost a loved one, you may be entitled to compensation to cover things such as funeral expenses, medical fees, and loss of income or contribution.

This compensation is essential for helping victims and their families recover from the financial and emotional impact of the accident.

Breaking down the stereotypes surrounding compensation claim

One of the most significant reasons people avoid making an accident compensation claim is the stigma surrounding it.

Many people view the claims sector as a negative thing, often labelling it as “compensation culture.”

Families who receive compensation for the loss of a loved one may also feel guilty about accepting money.

However, it is important to remember that compensation is not only a legitimate option but often necessary. Our specialist lawyers can advise you on whether you have a valid case or not.

Another common fear is that making a claim is too much hassle. However, by hiring a solicitor to manage the claim on your behalf, you can focus on what matters, and the solicitor can deal with the nitty-gritty work like submitting the claim and handling paperwork.

Additionally, people may avoid claiming compensation because they fear confronting the responsible party or going to court.

Your solicitor will handle most of the communication, and the vast majority of cases are settled out of court. Compensation claims fall under civil law, not criminal law, making the process less intimidating.

When Mrs L from the Wirral was riding on the back of her husband’s motorcycle when a car emerged from a side road, causing a collision.

In addition to the open fracture to her right leg, Mrs L also sustained a broken arm and several lacerations all over her body.

Due to the severity of the accident, she was forced to undergo several operations and needed to undergo plastic surgery on her leg due to the extent of her injuries.

Following the accident, the driver who was at fault admitted liability and the case was settled for £79,000, allowing Mrs L to receive intensive physiotherapy, rehabilitation, and counselling for post-traumatic stress disorder.

Mr B from Liverpool suffered a broken leg, crush injury to his right foot and fracture to his arm. He also suffered significant psychiatric injury.

He was riding his motorbike along a single carriage road when the defendant’s BMW moved into the oncoming lane and hit him. The defendant admitted full liability.

With ongoing pain from his injuries and restriction in movements meaning it affected his work, the claim settled in favour of Mr B with compensation that really helped him rehabilitate his life.

Mr R from the Wirral suffered significant cuts, bruises and soft tissue damage to his shoulder, neck, ribs and back.

After a routine journey, a car came at the biker from the opposite direction, causing Mr R to brake fast and suddenly.

Unfortunately this caused the rider to be flung from the bike into the air and then landing onto the road where his shoulder took the impact.

The resulting physical injuries were nasty and physiotherapy and acupuncture formed part of the significant rehabilitative treatment he needed.

In addition, there was the shock and psychological effect of the accident. Counselling sessions and therapy were needed.

A settlement was awarded with a sum for injuries and a sum for expenses.

Miss L from Chester was driving home from work on her cb750 Hornet where she was approaching a zebra crossing that had a pedestrian waiting to cross.

She stopped but the car behind her did not, Miss L was thrown off her bike and landed hitting her head and left shoulder.

She went to hospital and was treated for severe bruising. A month later, still in pain she saw her GP and was prescribed painkillers.

After having physiotherapy for over a month her work was still being affected due to her being in constant pain. This resulted in time off work and loss of earnings.

The settlement compensated Miss L for both pain and suffering and loss of her earnings.
